Rules and Regulations Board Meets

COVID19 Funding (Jan. 6, 2023) – The committee heard from Dorothy Noblit at the Division of Health Finance, Kansas Department of Health and Environment. The agency updated the Board that on Apr. 1, the Public Health Emergency ending will allow them to reprocess and certify those who have been on Medicaid since the beginning of the Public Health Emergency. In addition, Noblit testified that on Apr. 1, the agency can begin processing the discontinuation of Medicaid beneficiaries, and they are anticipating a backlog of Medicaid state fair hearings. As a result of that anticipated backlog, the agency is seeking a review of proposed temporary rules and regulations of: K.A.R 129-7-17, 129-8-17, and 129-9-17 concerning the department’s Medicaid state fair hearings summary. The proposed regulations would double the amount of time to collect and submit evidence for requested hearings.

The committee heard that currently, there are approximately 500,000 Kansans on Medicaid, and since the beginning of the Public Health Emergency, 175,000 applications have not yet been processed to determine if they are still eligible.

The agency presented that the plan is to begin in April or May to process redeterminations by month of the beneficiary renewal, so if they are due for renewal in April, they will re-determine in April, etc. At that time, the right for each beneficiary to a state fair hearing will be triggered. These rules and regulations deal with the state fair hearing process and anticipate an increased workload.

They hope to have changes and permanent regulations to the Attorney General’s Office within 120 days.

The committee also heard from Courtney Cyzman from the Kansas Board of Healing Arts regarding temporary rules and regulations K.A.R. 100-54-13 regarding the implementation of Senate Bill 440 related to Professional Liability Insurance for Occupational Therapist Licensing in Kansas. The committee heard that the changes are in-line with industry standards but meet the requirements laid out in Senate Bill 440. K.A.R. 100-54-13
The Board approved the proposed temporary regulations for both.
